Terms & conditions of hire

1.    HIRER OBLIGATIONS

1.1 Full payment or deposit of hire is deemed as the Hirer reading, understanding and accepting the full terms and conditions stated here.
1.2 Hirer must be over the age of 18. Fun Uncle Hire will require to sight photo ID as proof of age at time of delivery, which matches the ID number given with signature. Fun Uncle Hire is under no obligation to leave equipment if proof of age is refused to be shown.
1.3 Hirer agrees to defend, indemnify, assume liability for and hold Fun Uncle Hire harmless from any and all claims, demands, damages, losses, suits, proceedings, penalties, expenses or other liabilities including lawyer fees and court costs, arising out of or resulting from the use of any equipment regardless of the basis.
1.4 The equipment remains the property of Fun Uncle Hire at all times. The hirer may not transfer this contract to another party without written consent of Fun Uncle Hire.
1.5 The hirer must inspect and check all equipment and notify Fun Uncle Hire at the time of delivery if there is any equipment missing, damaged or unfit for use. Failure to do so will see the hirer responsible for any damages or missing equipment upon pick up.

2.    PAYMENT OF HIRING FEE AND SECURITY DEPOSIT

2.1 Full payment is required to secure booking. Booking is not secure unless the fee is paid in total. 
2.2 Before the equipment has been dispatched from Fun Uncle Hire, a $200 security deposit for the speaker is paid upfront by the Hirer. This deposit will be returned after equipment has been tested and checked and all additional accessories and cases etc has been returned. The deposit will be returned via Direct Deposit or Cash. It may take 5-10 business days for the deposit to be returned. 
2.2 To ensure booking is confirmed, the deposit needs to be paid upfront prior to the Hiring Period commences. 
2.3 It is agreed by between both parties that the deposit may be applied to cost of replacement, equipment repair, additional servicing or cleaning and any short fall from equipment being returned late. 
2.4 For outdoor or exposed events - In the event of any or all of the following: forecasted rain; storms; heavy winds; hail; severe heat; or any other extreme weather conditions, the $200 security deposit will be supplemented by a $1000 deposit per speaker.
2.5 In the case of cancellation, the hiring fee is refundable less 10% if the cancellation is more than 7 days prior to the event date. If cancelled within 7 days of the event day (7th day included), no refund will be given. NO refunds for bookings in the months of December and January and any school holidays.
2.6 Bookings made in December and January require a 50% NON-REFUNDABLE deposit.
2.7 A late collection fee of $50.00 will be payable by the hirer if any of the equipment is not available for collection on the set collection day and time arranged. (i.e. property is locked or unattended).
2.8 Fun Uncle Hire will keep all customer information confidential including credit card details, addresses, identification details. All information will be securely destroyed 6 months after all invoices and transactions have been finalised.
 

3.    DAMAGE TO/LOSS OF HIRED EQUIPMENT

3.1 The hirer is responsible for the safe keeping of all equipment from the delivery time to pick-up time.  Any damaged/lost/stolen equipment will be paid for by the hirer immediately on demand by Fun Uncle Hire.
3.2 The hirer agrees to pay Fun Uncle Hire the replacement value for any equipment if lost, stolen or damaged between the times of delivery and collection.  Furthermore the hirer agrees they will be responsible for any loss of income on any damaged/lost or stolen equipment caused by the hirer at the current daily hire charge rate until ALL outstanding invoices are paid in full.
3.3 The hirer will at all times comply with the operating instructions relating to the operation and handling of equipment.
3.4 The hirer shall be responsible for ensuring that equipment is kept undercover at all times and is not exposed to rain, water, high humidity, direct sunlight, heat or any other damaging elements.
3.5 The hirer agrees that the equipment will not be accepted as returned in good working order and/or condition, until it has been tested by Fun Uncle Hire staff.

4.    CLEANING

4.1 The hirer agrees that the Slushie machine is not to be dismantled or cleaned.
4.2 All Slushie machines must be returned emptied of all liquids and flushed out with water. 

5.    POWER CONNECTION AND POSITIONING

5.1 The maximum extension cord length permitted is 10 meters measured from the first power point. 
5.2 All equipment is to be kept under a permanent shelter or marquee with side walls (for protection again the weather).  It is not to be kept under a tarpaulin or in the open air. 
5.3 Slushie machines work best at ambient temperatures below 30 degrees. The machine may not be as effective at ambient temperatures above 30.1 degrees
5.4 If the Slushie machine does not freeze due to the environment it has to be placed in (e.g. cramped area, no ventilation, and non air conditioned area) or if the power supply is not suitable to keep the machine running, the hirer will still be required to pay the full amount.
5.5 The cocktail/Slushie machine will require a sturdy table due to the weight of the machine (70kgs). A glass topped table, or a foldable table IS NOT SUITABLE. Fun Uncle Hire reserves the right to not leave the equipment if the table surface is not deemed appropriate to avoid damage or accidents.
5.6 All equipment needs to be positioned on an even ground, to avoid tipping.

6.    STORAGE AND TRANSPORT

6.1 The hirer will be responsible for storing all hired equipment in a lockable room when hired overnight.
6.2 If the hirer, a friend of a hirer or any other persons help our driver or representative to move or set up the machine, this is at the customers or customers friend’s discretion and we do not accept any responsibility whatsoever if the hirer, the hirer’s friend or any other persons known by the hirer for injuries to themselves in any way.

7.    MALFUNCTION OR FAILURE

7.1 In the event of a failure or malfunction of equipment the hirer will immediately contact Fun Uncle Hire. Hirer is to leave a voicemail if there is no answer.
7.2 In the event of there being a failure or malfunction of the equipment during the time it is in possession of the hirer, which does not arise through misuse, mistreatment or some other breach of this agreement by the hirer, the hirer acknowledges that Fun Uncle Hire will be responsible for a partial or complete refund of the hiring fees.
7.3 Fun Uncle Hire’s liability to the hirer in such circumstances shall be limited to a maximum of a complete refund of the hiring fee. (Refund depends on how much equipment could still be used). 
7.4 The hirer agrees to indemnify Fun Uncle Hire in relation to all claims by persons or entities who are not parties to the agreement arising out of the failure or malfunction of any equipment during the time of hire.
 

8.    PRIVATE OR PUBLIC RESIDENCE

8.1  The hirer agrees that the hired equipment will stay at the nominated address the entire time from delivery time to pick-up time. 
8.2 Fun Uncle Hire has the right to determine if the premises are secure for storing equipment at the premises overnight.  If the premises are not secure after inspection on delivery of equipment, arrangements will be made to collect the equipment after the event and an after hours fee may apply.

9.    USE OF PRODUCTS FOR EQUIPMENT

9.1 The hirer agrees that the only products to be used in the equipment are the products supplied by Fun Uncle Hire. For example, the cocktail/Slushie mixes. 
9.2 The hirer agrees that there will be no refunds on unused products for the equipment.
9.3 Fun Uncle Hire will not be held liable for any injury/allergic reaction arising out of the use or rental of the hired equipment.
9.4 The hirer is responsible for all intake and reactions regarding allergies or intolerances.
9.5 If requested before the event, Fun Uncle Hire will supply additional syrups. These are NON-REFUNDABLE even if unopened. 

10. ALCOHOL AND LICENSE

10.1 Fun Uncle Hire does not hold a liquor license and therefore does not supply any alcohol.
10.2   All Slushie machines and syrup mixes are supplied non-alcoholic and if the customer adds alcohol into our machines they assume responsibility for the responsible service of alcohol.
10.3   The hirer may at their own discretion add alcohol to the supplied mixes (if desired) and does so at their own risk. Fun Uncle Hire does not assume liability in such case.
